Sean Higgins rejected an offer of 35 years in prison if he pleaded guilty in the deaths of NHL star Johnny Gaudreau and his brother.

Defense attorneys say that the Gaudreau brothers were drunk at time of fatal crash last August and filed a motion to dismiss the case.
